The National Court has upheld the €15,000 fine imposed on a journalist from ‘El Confidencial’ by the National Securities Market Commission (CNMV). The court confirmed this sanction upon finding that the reporter bought shares of the company OHL days before publishing an exclusive news story about it.

According to the ruling, the journalist's actions were considered an improper use of insider information, which contravenes securities market regulations. This decision sets a precedent in the enforcement of rules regarding illegal conduct in the financial sector.

The CNMV's resolution was the first sanction of this type imposed on a journalist and has sparked a debate about ethics in financial journalism and transparency in information gathering.
